Lunifer Terms of Service
1. Overview
Welcome to Lunifer. Lunifer is an application designed to help users plan and optimize sleep and wake times through scheduling inputs, behavioral data, and optional third-party integrations.
By accessing or using Lunifer, you agree to these Terms of Service. If you do not agree, do not use the service.
2. Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Lunifer. By using the service, you represent that you meet this requirement.
If you choose to connect a WHOOP or Oura Ring account, you must also meet those services' minimum age requirements, which require users to be at least 18 years of age.
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Lunifer app on devices you own or control, solely for your personal, non-commercial purposes.
4. Description of Service
Lunifer provides:
- Alarm scheduling and wake-time optimization
- Sleep recommendations based on user input and optional wearable integrations
- Calendar and routine-based planning tools
Lunifer is intended for informational and convenience purposes only and does not provide medical advice.
Lunifer is currently in a beta stage. Features may change, and the service may not function as intended at all times.
5. User Accounts
To access certain features, you may be required to create an account.
You agree to:
- Provide accurate and complete information
- Maintain the security of your account
- Notify us immediately of unauthorized use
You are responsible for all activity under your account.
6. Wearable and Third-Party Integrations
Lunifer supports optional integrations with WHOOP and Oura Ring, as well as calendar and other system services on your device.
By connecting WHOOP or Oura Ring:
- You grant Lunifer permission to access the relevant data you have authorized through that service's OAuth flow.
- You acknowledge that you have read and agreed to WHOOP's Terms of Use or Oura's Terms and Conditions, as applicable, and that your use of those services remains subject to their own terms and privacy policies.
- You acknowledge that Lunifer is not affiliated with, endorsed by, or sponsored by WHOOP or Oura Health.
- Lunifer is not responsible for the accuracy, availability, or security of data obtained from third-party services.
- We will not sell, license, or share your WHOOP or Oura data with any third party except as described in our Privacy Policy.
7. No Medical Advice
Lunifer does not provide medical, health, or sleep-related medical advice. All recommendations are informational only and should not be relied upon as a substitute for professional medical guidance.
8. Alarm Functionality Disclaimer
Lunifer aims to provide reliable alarm functionality, but:
- We do not guarantee alarms will trigger at all times
- Device settings, operating system behavior, or external factors may affect performance
You are responsible for ensuring you wake at required times.
9. Accuracy Disclaimer
Lunifer does not guarantee the accuracy of:
- Sleep recommendations
- Alarm timing calculations
- Data from wearable devices or third-party integrations
All outputs are estimates and may not reflect real-world conditions.
10. Acceptable Use
You agree not to:
- Use Lunifer for unlawful purposes
- Attempt to reverse engineer or interfere with the service
- Abuse or exploit system vulnerabilities
- Use Lunifer in any way that violates the terms of any connected third-party service
11. Data and Privacy
Your use of Lunifer is also governed by our Privacy Policy. We collect and process data necessary to provide the service, including:
- User-provided inputs (routine, schedule)
- Device and usage data
- Data from connected third-party services (if authorized)
12. Intellectual Property
All content, branding, and technology related to Lunifer are owned by Lunifer and its creators. You may not copy, modify, or distribute any part of the service without permission. WHOOP and Oura Ring are trademarks of their respective owners. Lunifer's use of those marks is solely for identification purposes and does not imply any affiliation or endorsement.
13. Disclaimer of Warranties
THE LUNIFER APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
14. Indemnification
You agree to indemnify, defend, and hold harmless Lunifer and its creator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of Lunifer, your violation of these Terms, or your violation of any rights of a third party.
15. Termination
We may suspend or terminate your access if you violate these Terms or misuse the service. You may stop using Lunifer at any time.
16. Limitation of Liability
To the maximum extent permitted by law, Lunifer shall not be liable for:
- Missed alarms or scheduling errors
- Inaccurate recommendations or outputs
- Indirect, incidental, or consequential damages
- Loss of data or personal inconvenience
17. Changes to the Service
We may modify or discontinue features of Lunifer at any time. We will make reasonable efforts to notify users of material changes that significantly affect the service.
18. Changes to Terms
We may update these Terms periodically. Continued use of Lunifer constitutes acceptance of the updated Terms.
19. Governing Law
These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict of law principles.
20. Apple App Store — Additional Terms
If you downloaded Lunifer from Apple's App Store, the following additional terms apply:
- These Terms are between you and Douglas Brown only, and not with Apple, Inc. ("Apple"). Apple is not responsible for Lunifer or its content.
- The license granted to you is limited to a non-transferable license to use Lunifer on Apple-branded devices you own or control, subject to the Usage Rules set forth in Apple's Media Services Terms and Conditions.
- Douglas Brown, not Apple, is solely responsible for providing any maintenance and support services with respect to Lunifer. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to Lunifer.
- In the event of any failure of Lunifer to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any, for Lunifer. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Lunifer.
- Douglas Brown, not Apple, is responsible for addressing any claims by you or any third party relating to Lunifer or your possession and/or use of Lunifer, including but not limited to: (i) product liability claims; (ii) any claim that Lunifer fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- In the event of any third-party claim that Lunifer or your possession and use of Lunifer infringes that third party's intellectual property rights, Douglas Brown, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
